IIM response to BERR consultation on opt-out

As previously reported, in March BERR issued a consultation paper on a package of proposed amendments to the ‘Conduct Regulations’ (the Conduct of Employment Agencies and Employment Businesses Regulations 2003).

The paper included a series of questions about the continuing need for the opt-out available to incorporated work-seekers including Interim Managers, enabling them to put themselves outside the scope of the Conduct Regulations.

In BERR's perception the opt-out may be being abused to the detriment of 'vulnerable workers' such as the low-skilled and migrants, and the paper proposed a menu of options to deal with this. These options include the removal of the opt-out, or its emasculation such that it would cease to have much practical benefit to Interims.
